Re: Notice of termination of employment (resignation)

Dear Sir or Madam,

I hereby give notice of termination of my employment, which I entered into under the employment contract dated [DATE OF EMPLOYMENT CONTRACT] for the position of [JOB TITLE], in accordance with section 50(3) of the Labour Code.

The notice period is [LENGTH OF NOTICE — AT LEAST TWO MONTHS]. It starts on the day this notice is delivered to you and ends on the day with the same number in the final month (section 51(1) of the Labour Code). My employment will therefore end on [LAST DAY OF EMPLOYMENT].

Please settle my final pay, including compensation for any annual leave not taken (section 222(2) of the Labour Code), and issue my confirmation of employment (zápočtový list) when my employment ends (section 313 of the Labour Code).

Before the end of the notice period I will hand over my work, equipment and access rights as you instruct. Thank you for the cooperation and the trust you have placed in me.

Yours faithfully,

Before you hand in your notice

The notice must be in writing, otherwise it is disregarded (section 50(1)). You do not have to give a reason (section 50(3)).

The notice period is at least two months and starts on the day the notice is delivered (section 51(1) and (2)). A longer period can only be agreed in writing and must be the same for both sides (section 51(3)).

The safest way is to hand over two copies in person and have the employer confirm receipt with a date and signature on your copy.

You can withdraw the notice only with the employer’s consent; both the withdrawal and the consent must be in writing (section 50(5)).

Compensation for untaken annual leave is paid only when employment ends (section 222(2)). The holiday calculator tells you how many hours you have left.

When you leave, the employer must issue a confirmation of employment (section 313). A work reference must be issued within 15 days of your request (section 314).

Alternative: termination by agreement (section 49)

Want to leave before the notice period ends? Propose an agreement to your employer. Employment then ends on the agreed day; the agreement must be in writing and each side receives one copy (section 49).

“The employer [EMPLOYER], company ID [IČO], and the employee [FULL NAME], born [DATE OF BIRTH], agree under section 49 of the Labour Code that the employment established by the employment contract dated [DATE OF EMPLOYMENT CONTRACT] ends on [END DATE]. This agreement is made in two copies, one for each party.”

If the agreement is made for organisational reasons (section 52(a) to (c)), state them in it: they give a right to severance pay (section 67).
